Family of Motorcyclist Disabled by September Accident Sues Naperville Driver

Lawyers acting on behalf of the estate of Michael Dunker are seeking in excess of $50,000 from Naperville resident Revanth Vema.

The family of an Aurora man who was left disabled after a multi-vehicle accident in Naperville in September has filed a lawsuit against the driver cited in the incident.

The law firm of Jeffrey J. Kroll filed the lawsuit Wednesday in DuPage County District Court on behalf of Erik Dunker who is representing the estate of Michael Dunker, 60. The complaint is seeking in excess of $50,000 and alleges that Revanth Vema, 28, of Naperville, was negligent.

The complaint alleges Vema was negligent of one or more of the following according to Illinois Compiled Statutes:

  • Negligently operated his motor vehicle.
  • Proceeded at a speed which was greater than reasonable and proper with regard to traffic conditions and the use of the highway, or which endangered the safety of persons or property.
  • Failed to decrease speed so as to avoid colliding with another vehicle (or person).
  • Failed to drive vehicle as nearly as practicable entirely within a single lane without first ascertaining that movement from such lane could be made with safety.
  • Failed to drive upon the right half of the roadway.
  • Failed to give audible warning with his horn when such warning was reasonable necessary to insure safety.
  • Was otherwise careless and negligent. 

The accident occurred around 6:16 p.m. Sept. 7 at Warrenville and Herrick roads, the Naperville Police Department has said.

Vema was driving a 2004 Honda Accord west on Warrenville Road, approaching Herrick Road, when it crossed over into the eastbound lanes of Warrenville Road and hit a 2000 Volvo S80 sedan heading east, according to the . Vema then continued westbound and struck the Harley-Davidson motorcycle in the curb lane of eastbound Warrenville Road, police said. A tire that flew off of the Volvo during the accident then struck a 2008 Acura MDX.

Dunker and his passenger Corrine Smith, 60, also of Aurora, were thrown from the motorcycle after being hit, both received life-threatening injuries, police had said after the accident.

Vema was cited on the day of the accident for driving left of center, Naperville Police Sgt. Gregg Bell said Thursday.
